Terms of service
Terms of service
These terms cover the optional OpenPixo account, credits, subscriptions and hosted generation. The desktop app and local features are free and open source; the software is governed by its open-source license.
1. What these terms cover
- The app. OpenPixo is released under the Apache-2.0 license. The desktop app and local features work without an account. App updates are free.
- The services. These terms apply when you create an OpenPixo account, buy credits, subscribe or use hosted generation. An account is only needed for cloud features.
- Other providers. Agents and providers you connect yourself, including your own API keys, are governed by their own terms.
2. Your account
- Sign in with an email one-time code or Google. Use an email address you control.
- You must be at least 13 to create an account. If you are under 18, you need permission from a parent or guardian to buy.
- An account is for one person. Keep access to it secure; you are responsible for activity under it.
- We may suspend an account for fraud, abuse of the services or payment disputes, and will explain why where we can.
3. Credits and subscriptions
- 1 credit = US$0.01 nominal. Credits are prepaid service units, not cash. They cannot be withdrawn, transferred or exchanged for money.
- Credits never expire, including subscription credits, and remain after cancellation. There are no free signup credits.
- The Starter subscription costs US$5/month and includes 600 credits each month. It is paid by card and renews monthly.
- Cancel anytime through the billing portal. Your subscription stays active until the end of the paid month.
- Top-up packs are one-time purchases paid by card or Alipay. Pack prices and credit amounts are on the pricing page.
- Prices are in USD. Taxes are added where required by law and shown at checkout. Stripe processes payments; credits are added after payment is confirmed.
- Purchase refunds follow the refund policy, including its 14-day conditions for unused packs and the first subscription payment. There are no partial-month subscription refunds.
4. Hosted generation
- You choose the prompt and reference files to upload. Only upload material you have the right to use.
- Available hosted services and their per-use credit prices are shown in the app before you confirm. Credits are spent only when you confirm a hosted generation.
- Credits are reserved for the job. If generation fails, the reserved credits are returned automatically.
- Media providers run the jobs. Availability and supported settings depend on the selected service.
5. Your content and results
- Your projects and the files you upload stay yours. OpenPixo claims no ownership of them or your generated results.
- Rights in generated results depend on applicable law and the terms of the provider used. Review those terms before publishing or using a result commercially. We do not promise exclusive rights or clearance of third-party rights.
- Uploaded files and results are handled as described in the privacy page. Hosted results are stored privately for 30 days so the app can download them, then deleted.
6. Acceptable use
Do not use the services to:
- create illegal content or sexual content involving minors;
- infringe someone else's copyright, trademark or other rights;
- harass, impersonate or deceive people;
- evade credit charges, resell account access, or attack or overload the services.
7. Store items
The current Store catalog has no paid items. Each item's own license governs its use.
8. Availability and responsibility
- The services may be interrupted or unavailable. Keep your own backups and review generated results before using them.
- Responsibility for loss is determined by applicable law.
- Nothing in these terms limits mandatory rights you have under consumer law where you live.
9. Changes, governing law and contact
- Changes to these terms will be published here with their effective date. We will provide any notice or obtain any consent required by applicable law.
- These terms are governed by the laws of Ontario and the federal laws of Canada applicable there. Disputes are subject to the courts of Ontario, without limiting mandatory consumer rights.
